Terms of Service

These terms explain how Shopply works, what you can expect from us and what we expect from you. By creating an account or using the site you accept them, so please read them before you sign up.
1. Who we are
Shopply is operated by Digital Traders sp. z o.o., ul. Stefana Batorego 18/108, 02-591 Warszawa, Poland, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, XII Commercial Division of the National Court Register, KRS 0001253066, NIP 7011322455, share capital PLN 5,000. In these terms we call ourselves "Shopply", "we" or "us", and we call you "you" or "the member".

2. What Shopply does
Shopply is a cashback service. We work with online retailers and with affiliate networks that represent them. When you start your shopping trip from a link on Shopply and then buy something, the retailer pays us a commission. We share part of that commission with you as cashback.
Shopply is free to join and free to use. We are not a shop. We do not sell the products you see on partner sites and we are not a party to the purchase you make with a retailer.
3. Your account
You need an account to earn cashback. To register you must be at least 18 years old, act as a consumer rather than on behalf of a business, and give us a valid e-mail address and accurate details. One person may hold one account.
Keep your password to yourself. You are responsible for what happens on your account, so tell us straight away at [email protected] if you think someone else has access to it.
Your account, your cashback balance and any rights under these terms are personal to you. They cannot be sold or transferred to anyone else.
4. How cashback is earned
To earn cashback, sign in, open the retailer through a link on Shopply and complete the purchase in the same browser session. The retailer records the sale and reports it back to us through the affiliate network.
Tracking depends on cookies and on the retailer reporting the sale correctly, so cashback cannot be guaranteed on every purchase. Cashback often fails to track when you block or clear cookies, use ad blockers or private browsing, switch device or browser during checkout, visit another cashback or voucher site after leaving Shopply, or apply a discount code that did not come from Shopply.
Some products and payment methods are excluded by the retailer, for example gift cards, delivery costs, taxes, insurance add-ons, orders paid partly with vouchers and purchases made through a marketplace seller. Rates and exclusions are shown next to each retailer and can change at any time. The rate that counts is the one displayed when you click through to the retailer.
5. Pending and confirmed cashback
Cashback appears in your account as pending once the retailer reports the sale. It becomes confirmed only after the retailer approves it, which usually happens once the return window has passed. This can take from a few hours to several months, depending on the retailer.
A retailer can decline cashback, for example when an order is cancelled, returned, unpaid, duplicated or found to breach its own terms. We can only pay out what the retailer and the network actually pay us, so declined cashback is removed from your account. If a retailer or network fails to pay us for a transaction, we are not obliged to pay the related cashback to you.
6. Missing cashback
If a purchase does not appear in your account within seven days, you can raise a missing cashback claim. Send us the retailer name, the date and time of the click, the order number and the order value within 90 days of the purchase. We pass claims on to the retailer or network and share their answer with you. Claims sent after 90 days usually cannot be investigated, because retailers stop accepting them.
7. Payouts
You can request a payout once your confirmed balance reaches the minimum amount shown in your account. Payouts are made by PayPal, bank transfer and the other methods listed at the time of the request. Some methods are limited to certain countries or currencies.
Payouts go to an account in your own name. Before we release a payout we may ask you to confirm your identity, your address or your ownership of the payment account, and we may hold the payment until you do. We may also hold a payout while a suspected fraudulent or reversed transaction is being investigated.
Cashback is a share of commission, not interest, and your balance does not earn interest. Where a payout involves a currency conversion, the rate used is the one applied by the payment provider on the day of the transfer.
8. Promotions and codes
We sometimes run promotions, bonuses and discount codes. Each promotion may have its own rules, its own end date and its own eligibility conditions, and those rules apply on top of these terms. We can withdraw or change a promotion at any time, and we can remove a bonus that was awarded in error or claimed in breach of its rules.
9. Fair use
Shopply is for personal shopping. You must not open more than one account, register with someone else's details, buy on behalf of a business for resale, use bots, scripts or automated tools on the site, place orders with the intention of cancelling or returning them to generate cashback, or take part in any scheme designed to earn cashback without a genuine purchase.
You must also not copy our content, extract our data for another service, interfere with the site or attempt to gain access to parts of it that are not meant for you.
10. Suspension and closure
We can suspend or close an account, cancel unconfirmed cashback and refuse a payout if we reasonably believe these terms have been broken, if the activity on the account looks fraudulent, or if we are required to do so by law. Where we do this, we will tell you the reason unless the law prevents us.
You can close your account whenever you like by writing to us. Confirmed cashback above the minimum payout amount will be paid out before the account is closed. Pending cashback that has not yet been confirmed by the retailer is lost when an account closes, because the retailer stops reporting it to us.
If an account stays inactive for 12 months, meaning no sign in and no tracked purchase, we may close it after giving you notice by e-mail and a chance to claim your balance.
11. Your relationship with retailers
The purchase contract is between you and the retailer. Delivery, returns, warranties, complaints about the product and the retailer's own terms are matters between the two of you. We are happy to help chase missing cashback, but we cannot resolve a dispute about the order itself.
12. Availability of the service
We try to keep Shopply available and accurate, but we do not promise that the site will be free of interruptions or that every rate, retailer description or promotional listing is correct at all times. We may change, suspend or discontinue parts of the service, and we may add or remove retailers.
13. Our liability
We are liable to you for damage caused by our failure to perform this agreement in line with Polish law. We are not liable for cashback that did not track because of how you shopped, for a retailer's decision to decline cashback, or for losses that were not a foreseeable result of our failure.
Nothing in these terms limits liability that cannot be limited by law, including liability for damage caused intentionally, for harm to life or health, or your statutory rights as a consumer.
14. Intellectual property
The Shopply name, logo, site design and content belong to us or to our partners. You may use them only as far as it is needed to use the service. Retailer names and logos belong to the retailers.
15. Complaints
If something goes wrong, write to [email protected] with your account e-mail address and a description of the problem. We answer complaints within 14 days of receiving them, and we will tell you if a case needs longer.
16. Consumer rights
Because Shopply is free, you owe us nothing for the service. You can withdraw from this agreement within 14 days of registering, and after that you can close your account at any time, both without giving a reason.
If a complaint is not resolved to your satisfaction, you can use out-of-court dispute resolution. Consumers in the European Union can also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
17. Changes to these terms
We may change these terms, for example when the service changes or when the law requires it. We will publish the new version here and, for changes that affect you, tell you by e-mail at least 14 days before they take effect. If you do not accept a change, you can close your account before it applies.
18. Governing law
These terms are governed by Polish law. This does not deprive you of the protection given by the mandatory rules of the country where you normally live. Disputes are settled by the courts with jurisdiction under those rules.
